Internal rules for trainees

These internal rules (règlement intérieur) apply to anyone attending a Kailli training course organized by DAZZ SOLUTIONS, in person or remotely. They are given to each trainee before the training begins.

This English version is a courtesy translation. Only the French version is legally binding; in case of discrepancy, the French version prevails.

Article 1. Purpose and scope

These rules are established pursuant to Articles L6352-3, L6352-4 and R6352-1 to R6352-15 of the French Labour Code (Code du travail). They set out the health and safety measures, the disciplinary rules, the nature and scale of sanctions, the procedural safeguards and the arrangements for trainee representation.

They apply to all trainees, for the entire duration of the training, wherever it takes place:

  • on the client company's premises (in-house training);
  • in a room made available for the purpose (multi-company sessions), anywhere in France;
  • remotely, in a virtual classroom.

DAZZ SOLUTIONS does not have its own premises for hosting trainees.

Article 2. Health and safety

Each trainee complies with the health and safety instructions of the training venue, in particular the fire and evacuation instructions.

When the training takes place in a company or establishment that already has its own internal rules, the health and safety measures of those rules apply to trainees (Article R6352-1 of the French Labour Code).

It is forbidden to enter or remain at the training venue while intoxicated or under the influence of drugs, to bring alcoholic beverages or drugs onto the premises, and to smoke or vape indoors.

Any accident or incident occurring during the training, or while traveling to or from it, must be reported to the trainer without delay. For a trainee who is an employee, DAZZ SOLUTIONS informs the employer, who is responsible for declaring the accident.

Article 3. Information provided to the trainee

Before the training, DAZZ SOLUTIONS gives each trainee a precise description of the training: content, schedule and number of hours.

Information relevant to the course is sent to the trainee by email:

  • these internal rules;
  • the training program;
  • their notice to attend (convocation);
  • the schedule, with dates and times;
  • the assessment questionnaires;
  • the certificate of completion.

Article 4. Remote training

For remote training, each trainee provides their email address and mobile phone number. DAZZ SOLUTIONS uses them only to organize the training and handle its administration.

A few days before the training, the trainee receives the virtual classroom link, a description of the teaching tools used and the contact details of a technical contact person to reach in case of connection problems.

In the virtual classroom, each trainee attends the training from a quiet place, with the equipment specified in the notice to attend. They display their first and last name and stay connected for the whole session, so that their attendance is recorded. The disciplinary rules of these internal rules apply in the same way.

Attendance is checked every half-day [remote attendance sign-in method: to be confirmed]. A prolonged disconnection without good reason is treated as an absence.

No person not enrolled in the training may attend the virtual classroom without the authorization of the person in charge of the training.

It is forbidden to record, film or take screenshots of the sessions and of the other participants without their consent and that of the trainer.

Article 5. Schedules, attendance and absences

Schedules are set by DAZZ SOLUTIONS and communicated in the notice to attend. Unless otherwise stated in the notice, they are generally 9:30am to 1:00pm and 2:00pm to 5:30pm.

Under the trainer's responsibility, each trainee signs an attendance sheet every half-day [paper or electronic: to be confirmed].

In the event of absence or lateness, the trainee notifies DAZZ SOLUTIONS at contact@kail.li, to the attention of Morgan Godard, training contact person, and provides a justification. The trainee does not leave the training during scheduled hours, except in exceptional circumstances accepted by the person in charge of the training.

For a trainee who is an employee, the employer is informed of their absences. Absences are also reported, where applicable, to the bodies funding the training.

Article 6. Short absences, long absences and dropping out

The trainer and the person in charge of the training classify each absence after a written or telephone exchange with the trainee. A written report justifies their decision.

  • Short absence: it does not prevent the training objectives from being achieved and does not disrupt the course. The trainee resumes the training and catches up on what was missed.
  • Long absence: it jeopardizes the achievement of the objectives or the running of the training. It is treated as dropping out.

Justified dropping out: if the trainee provides supporting evidence or a valid explanation, DAZZ SOLUTIONS offers them a place in another session of the same training or in another training course.

For the client who ordered the training: contractual consequences are governed by the general terms and conditions of sale (CGV), with no automatic 20% withholding and no disciplinary financial penalty against the trainee.

Article 7. Conduct, commitments and use of tools

Each trainee undertakes to:

  • respect the trainer, the other trainees and the staff of the training venue;
  • use the equipment and tools provided for their intended purpose, and return them in good condition;
  • in exercises with AI tools, use only data authorized by their company: no third-party personal data, and no trade secrets outside the framework agreed before the training;
  • keep the training materials for their internal professional use, without distributing them, in accordance with the general terms and conditions of sale;
  • complete the assessment questionnaires sent at the end of the training;
  • complete the work requested by the trainers, which is mandatory;
  • keep confidential any information about the personal or professional situation of other trainees learned during the training or the breaks;
  • limit phone use to breaks, except in an emergency.

Group life is based on respect for each person, commitment to collective work and the confidentiality of situations discussed during the training.

Article 8. Equal treatment, freedom of expression and neutrality

In accordance with Article L6352-4 of the French Labour Code, when it applies for funds from the funding bodies referred to in Article L6316-1, DAZZ SOLUTIONS ensures equal treatment of all trainees. It ensures respect for freedom of expression and of conscience, as well as the neutrality of the teaching provided.

Each trainee may ask questions and express disagreement, with respect for others and for the proper running of the training.

Article 9. Harassment, violence and discrimination

Moral or sexual harassment, sexist conduct, violence and discriminatory remarks are prohibited. A trainee who is a victim or witness may report it confidentially to the trainer or to [contact person to be confirmed].

Article 10. Sanctions

A sanction is any measure, other than verbal remarks, taken by the director of the training provider or their representative following conduct by the trainee considered to be misconduct (Article R6352-3). Depending on the seriousness of the facts, the sanctions are:

  • a written warning;
  • temporary exclusion from the training;
  • permanent exclusion from the training.

Fines and other financial penalties are prohibited. The director of the training provider informs the employer and the funding body of the sanction taken (Article R6352-8).

Article 11. Disciplinary procedure

No sanction may be imposed without the trainee first being informed of the grounds held against them (Article R6352-4). When the sanction being considered affects, immediately or not, their attendance at the training (Article R6352-5):

  • the director or their representative summons the trainee in writing, by registered letter or by hand delivery against a signed receipt, stating the purpose, date, time and place of the interview;
  • the summons states that the trainee may be assisted by a person of their choice, in particular the trainee delegate (délégué de stage);
  • during the interview, the director or their representative states the reason for the sanction being considered and hears the trainee's explanations.

The sanction may not be imposed less than one clear day (jour franc) or more than fifteen days after the interview. It is the subject of a written, reasoned decision, notified by registered letter or by hand delivery against receipt (Article R6352-6).

If conduct makes a temporary exclusion with immediate effect essential, as a precautionary measure (à titre conservatoire), no final sanction may be taken without this procedure having been followed (Article R6352-7).

Article 12. Trainee representation

For training organized in sessions with a total duration of more than five hundred hours, a delegate and an alternate delegate are elected by two-round single-member ballot, during training hours, no earlier than twenty hours and no later than forty hours after the start of the first group session (Articles R6352-9 and R6352-10).

Delegates are elected for the duration of the training. They make any suggestion to improve how it runs and present the trainees' complaints (Articles R6352-13 and R6352-14).

Article 13. Complaints

Any complaint about the training must be sent in writing to contact@kail.li. How it is handled is described in the general terms and conditions of sale.

Article 14. Distribution and entry into force

These rules are sent to the trainee by email and provided with the training agreement or contract. They remain available on this page. The general terms and conditions of sale apply to the client who orders the training.

Entry into force: [date to be confirmed]. For DAZZ SOLUTIONS: [name and title of signatory to be confirmed].
